SEBI's Search and Seizure Operations
Background: In early July, SEBI officials visited the homes and offices of approximately 10 traders. These traders were seen to be shorting stocks through options just before regulatory actions were announced.
- Investigations: SEBI initiated investigations in June, focusing on trades executed around the time when regulatory actions were taken against certain banks and non-banking financial companies (NBFCs).
- Profit Patterns: The traders in question had carried out several transactions, possibly executing close to 10 such trades. Although the profits in each instance were not substantial, the maximum gain was around Rs 1 crore.
- Access to Price-Sensitive Information: SEBI's probe aims to determine whether these traders had access to price-sensitive information that allowed them to profit from their actions.
- Search-and-Seizure Significance: Search-and-seizure operations are more serious than standard inquiries. They involve intrusive examinations and may imply more serious allegations. SEBI resorts to this approach when there is a risk of evidence tampering or when cooperation is lacking from the parties under investigation.
